Terms and Conditions of Rental
Effective Date: January 2025
Welcome to Alphard Bali (the “Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the website and the rental of vehicles, including the Toyota Alphard, and any associated services (such as chauffeur service) provided by the Company in Bali, Indonesia.
By making a booking or using our services, you agree to be bound by these Terms.
1. Eligibility and Driver Requirements
A. Renter Eligibility (Self-Drive)
The renter and any authorized drivers must meet the following criteria at the time of booking and throughout the rental period:
Be a minimum of 25 years of age (or as required by local insurance).
Hold a valid, full, and current driving license for at least two years.
Possess a valid International Driving Permit (IDP), which must be presented along with their original home country license. Failure to present an IDP may void the rental contract and any insurance.
B. Chauffeur Service
If you hire a vehicle with our professional driver, the driver is exclusively responsible for the operation of the vehicle. You and your passengers must adhere to the driver’s safety instructions.
2. Reservation and Booking
A. Booking Confirmation
A reservation is confirmed only when the Company sends a written confirmation (via email) and after the required deposit or full prepayment has been successfully processed. The Company reserves the right to decline any booking request.
B. Pricing and Payment
Rental charges are calculated based on the confirmed rate for the vehicle type and duration.
What You See Is What You Pay: Our quoted price includes all standard taxes and mandatory insurance (unless specified).
Exclusions: Prices do not include fuel, road tolls, parking fees, traffic fines, or charges resulting from breach of these Terms.
A refundable security deposit is required for all self-drive rentals and must be paid prior to vehicle handover.
C. Cancellation Policy
Cancellations made more than [e.g., 7] days before the start date: Full refund of the rental fee, less any bank charges and administrative fee.
Cancellations made less than [e.g., 7] days before the start date: The security deposit (if paid separately) may be returned, but the full pre-paid rental fee may be forfeited.
No-Shows: If the renter fails to collect the vehicle on the confirmed date and time, the full rental fee will be forfeited.
3. Vehicle Use and Obligations
A. Pick-Up and Return
The renter must present the required documentation (driver’s license, IDP, passport, credit card) at pick-up.
The vehicle must be returned to the agreed-upon location, date, and time. Late returns may incur an extra day’s rental charge.
B. Prohibited Use
The vehicle must not be used:
By any unauthorized driver.
For any illegal purpose, racing, or off-road driving.
To carry passengers or property for hire (unless explicitly hiring a chauffeur service).
To propel or tow any other vehicle or object.
Under the influence of alcohol, drugs, or medication that impairs driving ability.
C. Maintenance and Responsibility
The renter is responsible for checking the vehicle’s oil, water, and tire pressure daily and for immediately reporting any mechanical defects or damage to the Company. Any expenses for minor repairs will be reimbursed only with the Company’s prior authorization and submission of a valid receipt.
4. Insurance and Liability
A. Standard Coverage
Our rental vehicles include basic mandatory insurance coverage. Details of the insurance, including liability limits and exclusions, will be provided in the rental agreement signed at pick-up.
B. Renter’s Liability
The renter is responsible for the full amount of the insurance deductible (excess) in the event of any damage to the vehicle, regardless of fault.
The renter is fully liable for all damages or losses if the damage occurs while the vehicle is being used in breach of these Terms (e.g., unauthorized driver, driving under the influence).
The renter is responsible for loss or damage to the vehicle’s keys, documentation, or accessories.
C. Accidents
In the event of an accident, damage, or theft, the renter must immediately notify:
The local police.
Alphard Bali immediately via phone. The renter must complete an accident report form and cooperate fully with the police and the Company’s insurer.
5. Security Deposit
A security deposit is held to cover potential costs such as:
Insurance deductibles (excess).
Traffic fines, tolls, or parking penalties.
Charges for damage or loss not covered by insurance.
Refueling charges if the vehicle is returned with less fuel than provided.
The deposit will be fully released upon the safe and timely return of the vehicle, provided there is no damage, loss, or outstanding charges. Release times depend on your bank’s processing policy.
6. Jurisdiction and Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Indonesia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bali, Indonesia.
By proceeding with a booking or rental, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
